1.1 These terms and conditions (“Terms”) apply to the use and all sales made from https://formadore.co.uk (“Website”).
1.2 Owner of the Webiste is ProgressiveBG with registered office at Łomianki (Poland), 05-092 Łomianki, Warszawska st. 31 (“Seller”). Our tax number is 749-186-67-05.
1.3 The Seller has outsourced the operation of the Website to FormAdore Ltd. with registered office at London (United Kindgdom), 220c Blythe Road W14 0HH (“Operator”).
1.4 Your purchase of any of the products offered on the Website is subject to these Terms. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any products from the Website. We recommend to print a copy of these Terms for future reference.
1.6 The information on the Website is in English, all communications will be in English.

3. Use of the Website
3.1 You may use the Website only in acceptance with the Terms and law.
3.2 Comments with defamatory, abusive, obscene, unlawful content are strictly prohibited.
3.3 By using the Website you are obliged:
3.3.1 To use your own identity;
3.3.2 not to make any false or fraudulent orders;
3.3.3 to provide correct and accurate personal data in registering process or ordering process;
3.3.4 to make use of the Website in a way that does not disturb its functioning, especially by using appropriate software and tools;
3.4 If you have open an account on the Website you must treat your password as confidential information and must not disclose it to anyone. You may log in to your account on the Website via your account on the Facebook, Google or Twitter.
4. Service availability
4.1 Products offered on the Website are only available for delivery to the UK and the EU.
5. Age restriction
5.1 By placing an order through the Website, you warrant that you are at least 18 years old and are legally capable of entering into binding contracts.
6. Outsource of the Website
6.1 The Operator and the Seller cooperate in a dropshipping model, within which the Operator gathers on behalf of the Seller orders and provides services based on the rules defined in these Terms.
6.2 You are purchasing products from the Seller. The Operator takes care of the content and information on the Website and provides all proceedings to purchase Products from the Seller.
6.3 The contract to provide intermediary services between the Operator and you is a temporary contract – until the sale contract between the Operator and the Seller on behalf of you is formed.
6.4 The Operator receives from you the order and the payment and forms on his behalf the sale contract regarding the chosen products, completes the payment of the price and delivery costs, requests the Seller to deliver the Products directly to you.
7.1 The Website displays products that are advertised for sale, and gives information about them (“Product”).
7.2 Seller offers on the Website only new Products.
7.3 By advertising Products on the Website we are inviting you to place an order with us.
7.4 Please note that minor differences in colour and other variations in Products are possible as a result of different image display technologies or other technical reasons on your device.
7.5 We try to get Product descriptions, pricing and specifications right, but specifications may change and we reserve the right to withdraw or substitute Products if necessary.
8. Ordering process
8.1 You may order a Product using the Website via a purchase by adding Product to the basket or by telephone, or by email.
8.2 After you have placed an order on the Website we will send you an email acknowledging that we have received your order ("Order Confirmation"). Order Confirmation contains full details of the order, such as: order No, information of Products, prices, delivery cost, your shipping address and other.
8.3 After placing an order you must pay for the Products.
8.4 When your Product is shipped from our warehouse, we will send you a dispatch confirmation e-mail ("Dispatch Confirmation") and contract (“Contract”) between us will only be formed.
8.5 If you would like to place an order using email or by telephone, please provide us following information:
8.5.1 the name of the Product and its quantity;
8.5.2 the type of delivery and payment chosen from the proposed options on the Website;
8.5.3 the necessary information to process your order: name and surname, address and email.
8.6 All orders for Product are subject to availability. We may refuse order if we decide it is reasonable to do so in following circumstances:
8.6.1 products are unavailable or out of stock; or
8.6.2 we identify a product or pricing error on the Website; or
8.6.3 we are unable to obtain authorised payment or the payment process is incomplete; or
8.6.4 you fail to submit all necessary and relevant details to allow us to fulfil the order.
8.7 If you have already paid for the Product and we have cancelled the order, we will refund you the full amount as soon as possible. In the case of an order with multiple Products we will refund only that element of the order which relates to the price of the Product and we will not refund the delivery costs.
9. Price and payment
9.1 The price of any Products on the Website is quoted in GBP, USD, EURO.
9.2 The prices on the Website include VAT, delivery charges are shown separately. All applicable delivery charges are as stated on the Website at the time of placing of the order.
9.3 We accept payment via: PayPal or credit card.
9.4 We must receive payment for the Products and any delivery charges in full, before dispatching Products to you.
9.5 Prices for our Products may change from time to time, but changes will not affect any order you have already placed.
10. Delivery of Products
10.1 We aim to deliver the Products within the indicative timescales shown on the Website.
10.2 On the Dispatch Confirmation, all details of delivery charges and time will be provided depending on your location.
10.3 Estimated date of delivery will be within 5-35 working days after the date we started the Contract. If we miss the 60-day delivery deadline for any Products then you may cancel your order. However if you will not cancel the order you can give us a new deadline for delivery, which must be reasonable, and you can cancel your order if we do not meet the new deadline.
10.4 Products will be delivered to you by a delivery company – DHL Parcel.
11. Risk and title
11.1 The Product will be at your risk from the time of delivery.
11.2 Ownership of the Product will pass to you when we will receive the full amount of payment for the Product.
12. Cancellation right
12.1 Consumer has the right to cancel the Contract (subject to certain exceptions set out below) within 14 days without giving any reason.
12.2 The cancellation period is counted from the day of delivery of the Products of your order.
12.3 You can cancel the Contract by sending us the cancellation form provided or by letting us know in any way by post to London (United Kindgdom), 220c Blythe Road W14 0HH or by using email: [email protected] We suggest you to contact us by email, it is the fastest and the easiest way to communicate.
12.4 You must return the Products to us at your own risk and cost within 14 days of notifying us that you wish to cancel the Contract by sending them to: FormAdore / Eurohermes, Unit 17 Harnham Trading Estate, Netherhampton Road, SP2 8NW Salisbury.
12.5 Please note that you must ensure that you take reasonable care of the Product.
12.6 Right of cancellation does not apply in following cases:
12.6.1 the supply of water, gas, electricity or district heating - for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the cancellation period;
12.6.2 the supply of goods that are made to the consumer’s specifications or are clearly personalized;
12.6.3 the supply of goods which are liable to deteriorate or expire rapidly;
12.6.4 the supply of alcoholic beverages, where: (i) their price has been agreed at the time of the conclusion of the sales contract, (ii)delivery of them can only take place after 30 days, and (iii)their value is dependent on fluctuations in the market which cannot be controlled by the trader;
12.6.5 contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance;
12.6.6 the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications;
12.6.7 contracts concluded at a public auction;
12.6.8 the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.
12.7 If you cancel the Contract, we will reimburse you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
12.8 We will make the reimbursement without undue delay, and not later than 14 days from the day when we receive the Product from you or we receive the proof of shipment (whichever is the shortest)
12.9 We will use the same means of payment that you used for the purchase, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.
12.10 You are only liable for any diminished value of the Product resulting from their handling, other than that which is necessary to establish the nature, characteristics and functioning of the Product.
13. Faulty Goods
13.1 We warrant that the Products on the Website are of satisfactory quality and are fit for the purpose for which Products of that nature are commonly supplied.

13.3 If you return Products send to: FormAdore / Eurohermes, Unit 17 Harnham Trading Estate, Netherhampton Road, SP2 8NW Salisbury, we will inspect the Products and either replace them or refund the full purchase price of the Products if we accept that there is a manufacturing defect or other fault in the Products.
13.4 You have 30 days from the delivery date to raise a complaint and get full refund of Product and delivery costs. After this deadline we can offer you in first priority to repair or exchange.
13.5 You have 6 months from the date of buying Product to request repair or exchange. If those solutions are not possible or not effective, you may request a refund or a discount if you want to keep the Product. After 6 months the client needs to prove that the product was having a defect and usually you are not anymore liable for the costs related to the refund, unless the Product was really having a defect.
13.6 We will cover all the delivery costs related to the return of the Product by you.
14. Complaint regarding the Website or outsourced services
14.1 You may raise a complaint regarding the Website or the outsourced services to the Operator by post to London (United Kindgdom), 220c Blythe Road W14 0HH or by using email: [email protected]
14.2 In the complaint please provide all information regarding the complaint in particular: what is the problem with Website or the outsourced services and your name and address.
14.3 The Operator commits to proceed all complaints in a minimal amount of time and no longer than within 14 days.
15.1 Some of the Products come with a manufacturer's guarantee. For details of the applicable terms and conditions of the guarantee, please refer to the manufacturer's guarantee provided with the Products.
15.2 A manufacturer's guarantee is in addition to your legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
16.1 If any provision of these Terms are determined to be invalid, unlawful or unenforceable the remainder of these Terms shall continue to be valid and enforceable.
17. Consumer dispute resolution
17.1 If you have a complaint about the Website, Product or other, please contact us. We do our best to solve potential disputes.
17.2 In case the dispute between us is not resolved you may use the Online Dispute Resolution (ODR) platform that can be accessed through http://ec.europa.eu/odr. The ODR platform is free of charge.
18. Law and jurisdiction
18.1 Contracts for the purchase of the Products or any other dispute is governed by laws of England and Wales.
18.2 You submit to the non-exclusive jurisdiction of the courts of England and Wales.
18.3 Nothing in these Terms seeks to exclude or limit any rights available under applicable law which cannot be excluded or limited.
19.1 The copyright and other ownership rights in the Website and its contents (including design, text, logos, trade names, graphics, software and any other material) are owned by us or our licensors.
19.2 You must not publish, copy, distribute or modify any of the content of this Website without our prior written consent.
19.3 You must not make any copy of any material from the Website for any business related use whatsoever.
20.1 We have the right to amend these Terms from time to time. However, each Contract will be subject to the Terms that were in force at the time of your order.
