These Terms and Conditions govern the access to and use of formadore.com ("FormAdore Web Site"). The access to and use of FormAdore Web Site as well as the purchase of products are based on the assumption that these Terms and Conditions have been read, understood and accepted by the Customer.
FormAdore is a brand of ProgressiveBG, registered with the Companies' Register of Kedzierzyn-Kozle, Poland under no. 255/2005, Tax Code and VAT no. PL7491866705. ProgressiveBG registered office is in Poland at 05092 Lomianki, Warszawska 31.
ProgressiveBG reserves the right to update or modify these Terms and Conditions at any time without prior notice. The Customer agrees to comply with the current version of Terms and Conditions by using the FormAdore Web Site or making a purchase. For this reason, Customer should review these Terms and Conditions whenever purchasing products from FormAdore or use FormAdore Web Site.
While every care and attention has been taken to ensure that the contents of FormAdore Web Site are accurate and up to date, the information is provided "as is" and to the extent permitted by law, ProgressiveBG disclaims all liability and excludes all express and implied warranties in respect of any inaccuracy, errors or omissions in any of the information on FormAdore Web Site, any decision made or action taken in reliance on or as a result of the information on FormAdore Web Site or any delay to, interruption to or non-availability of the provisions of FormAdore Web Site regardless of how it is caused.
FormAdore offers for sale top-quality products. These products are purchased by FormAdore directly from manufacturers and dealers, carefully selected for their quality control. Products offered on the Website are compliant with the applicable legislation and standards in the EU.
All prices on FormAdore Web Site are indicated in Euro inclusive of VAT.
Prices are subject to change. The prices at the time of the posting of the order by the customer apply. The applicable price of the Order will be notified in the summary of the Order before payment.
For deliveries outside the European Union it is possible that the customer will have to pay for customs duties or any other taxes due to the import of products in the country of delivery. The Customer is also solely responsible for the formalities related thereto unless otherwise specified, and is solely responsible for checking whether the products ordered can be imported under domestic law in the country of delivery.
If the correct price of the goods is higher than the price stated on FormAdore Web Site, we may reject the Order in our discretion, in which case we will notify the Customer of such rejection and the correct price for the goods.
FormAdore ships worldwide with UPS.
As per International Laws regulating Commerce and Trade of imports and exports all orders are shipped out of Warsaw, Poland with an official invoice declaring the exact total of merchandise purchased in Euro including VAT.
Delivery inside European Union if free on orders above 70 EUR value.
Delivery on lower order values is charged 10 EUR shipping fee. The shipping costs are clearly stated on the order confirmation page.
Deliveries will be made according to the information on the product pages after confirmation of the order. If an Order contains Products deliverable at different dates, the Customer may choose to receive each Product according to the delivery dates stated on the Product pages of each item, by contacting the Customer service. However, this service may involve higher delivery costs to the Customer which will be indicated by the Customer Service. If the Customer chooses to receive his Order in one batch, the longest delivery period indicated on the Product pages shall be the one to refer to.
Availability information for products sold are listed on FormAdore Web Site, including on each product information page. 'Product on stock' information states, that at least 1 piece of item is available for immediate despatch. Despatch times presented on FormAdore Web Site are not guaranteed and should not be relied upon as such. As order is processed, FormAdore Customer Care will inform the Customer by email if any products turn out to be unavailable.
In case of absence of the Customer during delivery, a notice will be left by the UPS courier. Products may therefore be collected following carrier’s indications. In absence of Products’ withdrawal by the Customer in the limited period fixed by the carrier, the Products will be returned to FormAdore. FormAdore will reserve the right to reimburse the Customer, while the delivery costs will remain at the Customer’s charge.
Upon delivery of every order, Customers are asked to inspect the box carefully before signing for the delivery. FormAdore purchases are carefully packed in boxes with tape around the sides of the box.
If for any reason the box looks tampered with, either sign for the package with reservations or refuse the package. In the event that the box has been signed for with an unauthorized signature or there is evidence that the package has been tampered with, open a claim immediately with the courier and contact FormAdore Customer Care.
If the package is not successfully delivered to the Customer's address due to a lack of cooperation from the client (wrong telephone number, wrong address, absent at address, non-compliance with import regulations) as per the FormAdore commercial agreement, the package may risk being sent back to FormAdore warehouse at the Customer's expense including any import fees that may be assessed upon re-entry to Poland. These fees will be deducted from any eventual reimbursement.
When the order is shipped, Customer receives an E-mail from FormAdore specifying the UPS tracking number and a direct link to monitor the shipment status.
FormAdore does not deliver to P.O. Boxes.
Payments can be made by one of the following payment methods: Credit Card (MasterCard, Visa, American Express), PayPal, bank transfer or invoice (only selected business customers).
While paying by bank transfer, the bank details will be provided in the Order confirmation email. Failing receipt of the bank transfer within 7 days from the Order confirmation by FormAdore or in case of rejection by the bank, FormAdore is entitled to cancel the Order.
Payment by credit card is processed via PayPal. PayPal uses SSL-encryption in the communication with FormAdore and Customer. SSL is short for Secure Socket Layer and is a security protocol which ensures that data is encrypted in the communication between the customer and FormAdore. It is therefore not possible for 3rd parties to intercept any credit card information.
FormAdore welcomes payments from PayPal Accounts and reserves the right to process orders only if shipped to the same address that the verified Paypal account is registered with.
When Customer places an order to purchase a product from FormAdore by filling an online form and sending it electronically by clicking 'place order' button, FormAdore will send an email confirming receipt of Customers order and containing the details of the order. Customers order represents an offer to purchase a product which is accepted by FormAdore when the procuct is dispatched and confirmed by an email (the ‘Dispatch Confirmation E-mail’). That acceptance will be complete at the time FormAdore sends the Dispatch Confirmation Email to the Customer.
FormAdore reserves the right to refuse any order for any reason whatsoever, in particular for any problem of products procurement or any problem concerning the received order.
In case a Product would be unavailable, FormAdore will inform the Customer by e-mail as soon as possible. FormAdore will inform, for the new availabilities of the Product or may suggest an exchange with a similar Product.
Customer may return products purchased from FormAdore, without any penalty and without specifying the reason, within 30 days from receiving the products purchased.
In order to return an item Customer should contact Customer Care within 30 days of delivery date. The articles should be sent back to the address indicated by the Customer Care (returns addresses available in Germany, Czech Republic and Poland).
The item must be returned in new and unused condition, in the original box and with all paperwork, parts and accessories to insure full refund. New and unused means that there are no scratches, marks, or blemishes on the item; there are no signs of wear on the product, the tags, or the case; and the product must not have been altered in any way. FormAdore cannot accept a return of any item with any indication that it has been used.
Refunds will be processed as soon as returned items have been checked and accepted. For orders paid by credit card, the refunded amount will be available to customers in 10 days and within their next billing statement. Processing time may vary depending on the credit card company. Orders paid by Paypal or by bank transfer will be refunded to the original account.

These Terms and Conditions are governed by Polish law. This Polish law is applicable even when ordering from or delivering to a country other than Poland. All points of these terms and conditions remain valid, even if one of the above points is invalid.
